September 11,2001 Fund Rule Making

My wife, , died at the World Trade Center. I had
previously commented on the proposed regulations. Please accept my
additional comments on the proposed regulations.

I have read the comments of various individuals, Congresswomen and
Congressman, as reported in the January 7, 2002, edition of the New York
Times.

I believe the best method to reconcile those views with those of Mr.
Feinberg would be to raise the uniform award for non-economic losses to be at
least $750,000. Raising this minimum could save many families from making an
agonizing inquiry and investigation as to the circumstances of the victim's
death in their attempt to argue that "special circumstances" warrant an award
higher than $250,000.

One point that appears to have been overlooked recently is that when the
Fund was established by Congress, the estimate of dead and missing was
between 5000-6000 people. Thankfully, the toll has now dropped to
approximately 3120 people, and accordingly, the Fund should be able to
respond, more generously, per victim than previously thought.
